This End User Service Agreement (“Agreement”) oversees Your relationship with website and the Your Care Connect platform (referred to as the “Service”) operated by Ontario Shores Centre for Mental Health Sciences (Ontario Shores). The terms “You”, “Your” and “Yours” refer to the user/customer utilizing the App. This Agreement applies to the Service that You are authorized to use while this Agreement is in place. Your access to and use of the Service is based on Your acceptance of and compliance with this Agreement.

UNLESS THERE IS A LAW THAT REQUIRES OTHERWISE:
    I. ONTARIO SHORES DOES NOT PROVIDE WARRANTIES FOR THE SERVICE; and
    II. THIS AGREEMENT CONTAINS LANGUAGE THAT LIMITS ONTARIO SHORES’ RESPONSIBILITY. CONSEQUENTLY, PLEASE READ THIS AGREEMENT CAREFULLY.

1. CREATION OF YOUR CARE CONNECT SERVICE ACCOUNT

You can register and create Your personal account (“Account”) by using Your email and your login code provided to you by Ontario Shores Centre for Mental Health Sciences.

2. CONTENTS OF YOUR CARE CONNECT ACCOUNT:

Data stored within Your Account may contain the following personal information:
    i. Name
    ii. Email address
    iii. Secondary email address
    iv. Mobile phone number
    v. Home phone number
    vi. Preferred language
    vii. Emergency contact
    viii. General health information, including sleep data, from wearable devices as You consent

3. YOU ARE RESPONSIBLE FOR YOUR: YOUR CARE CONNECT ACCOUNT

You alone are responsible for when and how Your email and password (“Credentials”) are used, including access to Your Account. You are responsible for maintaining the privacy of Your Credentials and are responsible for all uses of Your Account with Your Credentials, even if the Account isn’t used or approved for use by You. You must notify Ontario Shores right away by email at yourcareconnect@ontarioshores.ca, if the security of Your Account has been compromised in any way. Non-personal and commercial accounts are not allowed under the Service.

4. USE OF THE SERVICE

You may start using the Service as soon as You have finished the sign-up process and agreed to the terms of this Agreement. While using the Service, You will:
    i. Comply with applicable laws and regulations;
    ii. Maintain the privacy of Your Account (including Credentials) and all uses of Your Account;
    iii. Promptly notify Ontario Shores if You observe or learn of a problem with the Privacy of Your Account or this Service.

5. IN USING THE SERVICE, YOU AGREE NOT TO:

    5.1 Use or allow anyone else to:

        5.1.1 Use the Service to perform any activity that is against any applicable laws; and/or

        5.1.2 If applicable, use the Service to transmit or send any inappropriate, improper, excessive, threatening or obscene material or to otherwise harass, offend, threaten, embarrass, distress or invade the privacy of any individual or entity;

    5.2 Do anything that could create a problem with the security of the Service or any network or computers on the Internet or disrupt or interfere with the services of another person or company;

    5.3 Create a problem with anyone’s privacy in any way including but not limited to:

        5.3.1 Misrepresenting the source of anything you may post, including imitating another person or company;

        5.3.2 Trying to collect, keep, or use another person’s personal information such as passwords, account information, credit card numbers, addresses or other contact information without their agreement;

    5.4 Provide false or misleading information;

    5.5 Avoid or get around any technology that is used to protect the Service;

    5.6 Do anything that would harm or interfere with another user’s device or would allow others to illegally access software or get around security on Web sites or servers, such as spam, resell, rent or redistribute the Service; and

    5.7 Undo, decompile, or reverse engineer any software included and/or use in the Service.

    5.8 Contravene any agreements signed as part of consenting to participate using this Service.

6. WARRANTY AND DISCLAIMER

EXCEPT AS STATED IN THIS AGREEMENT AND AS ALLOWED BY THE LAW WHERE YOU LIVE, YOU ADMIT AND AGREE THAT WE PROVIDE THE SERVICE ON AN "AS-IS" AND "AS AVAILABLE" BASIS AND YOUR USE OF THE SERVICE IS AT YOUR OWN RISK, WITH NO STATED OR WRITTEN ADDITIONAL REPRESENTATIONS, CONDITIONS OR WARRANTIES. WE DO NOT GUARANTEE A TIMELY, ERROR-FREE OR UNINTERRUPTED SERVICE OR THE ACCURACY AND COMPLETENESS OF YOUR ACCOUNT OR TIMELINESS OF INFORMATION AVAILABLE FROM THE SERVICE. THE SERVICE MAY FAIL OR BE INTERRUPTED FOR REASONS INCLUDING, BUT NOT LIMITED TO, ENVIRONMENTAL CONDITIONS, TECHNICAL LIMITATIONS, DEFECTS OR FAILURES, LIMITATIONS OF THE SYSTEMS OF TELECOMMUNICATIONS COMPANIES, EMERGENCY OR PUBLIC SAFETY REQUIREMENTS, OR CAUSES BEYOND OUR CONTROL.

7. LINKS TO OTHER WEB SITES

The Service may contain links to other people or company web sites or services that are not owned or controlled by Ontario Shores. You admit and agree that Ontario Shores will not be responsible for any damage or loss caused related to Your use of any content, goods or services available on or through any other websites or services.

Before making any Purchase, we recommend you read the terms and conditions and privacy policies of any other person or company’s web sites or services that you visit.

8. PRIVACY AND SECURITY

We are committed to protecting the security of your personal information. Ontario Shores applies industry standard safeguards to protect the confidentiality of your personal information. The systems used to provide the Services use a variety of security technologies and procedures to help protect Your personal information from unauthorized access, use, and disclosure. For example, the personal information within Your Account is stored on computer servers, with limited access, and which are located in controlled cloud-based environments facilities. Data encryption is used during transmission of personal information. Collection or transmission of information over the Internet or other publicly accessible communications networks You may use cannot be guaranteed to be 100% secure.

9. HOW WE USE YOUR PERSONAL INFORMATION

The terms applicable to the collection, use and/or disclosure of Your personal information by Ontario Shores are set out in the privacy policy available at , which is subject to change from time to time in accordance with its terms.

10. DURATION / TERMINATION / MODIFICATIONS

Once the Account is created by You, You will be able to access it until you decide to terminate Your Account, except if one of the following conditions exist.

We may stop providing you the Service:

    i. If You do not follow this Agreement;
    ii. If ending or pausing the Service is needed to prevent privacy and/or security problems or problems with the function or availability of the Service;
    iii. To comply with any applicable law or court order; and or
    iv. If We discontinue the provision of Service.

You may terminate this Agreement and terminate Your Account at any time by removing the Service application from Your mobile device. For Apple Health, you can simply disable the data synchronisation from Apple Health in iOS Settings. For Fitbit, you can remove the data sync option directly from Fitbit web portal. It is important to note, simply removing the application while using iOS Apple Health integration, the data will cease to sync. For another health provider such as Fitbit, the sync can be turned off from their portal however, we encourage you to also remove the application. Upon termination of Your Account, We will maintain a copy of Your Account for a period of seven (7) years from your last transaction or from the creation of Your Account.

11. GENERAL ACKNOWLEDGEMENT BY YOU and ONTARIO SHORES:

You and Ontario Shores admit and agree that Ontario Shores will retain all rights, title and interest in and to the Service , including copies of related materials.

This Agreement is the entire agreement between You and Ontario Shores , and replaces all previous verbal or written agreements about the Service. If a court determines that any part of this Agreement is not acceptable or enforceable, such unacceptable or unenforceable part will be considered as excluded from this Agreement.

12. ACTS OF NATURE OR OTHER SITUATIONS BEYOND CONTROL

You and Ontario Shores will not be responsible for failure or delay in function of the Service, due to fire, interruptions, failures or defects in internet, telephone or other interconnection service, interruptions, failures or defects in electronics or mechanical equipment, flood, riot, strikes, labour disputes or freight restrictions, acts of god or of the public enemy, war or civil disturbances, any future laws, rules, regulations or acts of any government or any event beyond the reasonable control of You or Ontario Shores that would cause a delay or prevent function of the Service. Upon the occurrence of an Act of Nature or Other Situation Beyond Control, the person who is affected will notify the other right away.

13. ASSIGNMENT

You may not transfer or give your rights or obligations under this Agreement to someone else. You may not transfer or give your rights to use any part of the Service to someone else. This Agreement is only for the benefit of You and Ontario Shores and not for the benefit of anyone else.

14. NOTICES

Any notice, request, demand, or other communication required or allowed may be delivered in electronic form. We may notify you by email at the e-mail address You specified when You signed up for the Service; or by notice directly in Your Account.

Any notice, request, demand, or other communication will be considered delivered when received by the person who is sent the communication.

15. GOVERNING LAW AND JURISDICTION

This Agreement and function will be overseen by the laws of the province of Ontario.
